Property Litigation

Property disputes cover a huge area of law, whether it’s multi-million NAMA proceedings, or the problems that arise between neighbours such as boundary disputes. The Land Reform and Conveyancing Act 2009  introduced a lot of changes in relation to many aspects of property rights including the practice of a Works Orders to allow for access to neighbouring lands in order to carry out works on party structures, and new time-frames and methodology for the obtaining and registration of easements such as rights of way. We can advise clients on their rights to protect the value of their property, on making planning objections (and appeals), unauthorised development complaints, how to deal with nuisance caused by your neighbours’ use of their adjoining property and advise on civil liability for farm yard and domestic animals, lopping overhanging branches and encroaching roots and civil liability for visitors on property and the right to self defence in the home. Our Firm will act promptly to obtain an injunction to prevent any infringement of your property rights. We will keep you informed of the costs and handle the litigation in a manner to ensure your costs are limited and to safeguard your chances of having costs awarded against the wrongdoer.
